All unclaimed personal property or money in the possession of the public safety department shall be stored in a safe place by the public safety director for at least three months. The public safety director shall restore such property to its legal owner upon proof of such ownership satisfactory to the director and upon payment of all reasonably necessary costs in the care and protection thereof, unless such property is held by the department as evidence in a pending case, in which case it shall be disposed of only upon order of the proper court.
