If, in the opinion of the road commissioner, the work proposed in any permit application entails any undue risk of injury, death or damage to any member of the public, he shall, prior to issuing such permit, require the applicant to file with him satisfactory evidence that the applicant is insured against all such risks, with such limits of coverage as the road commissioner may direct. This section shall not apply to any public agency authorized by law to establish or maintain any works or facilities in, under or over any public highway, nor to any public utility holding a valid franchise.
